1. Agreement to Terms

By accessing or using The Guest Helper ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

The Guest Helper is a SaaS platform that provides AI-powered WhatsApp automation for vacation rental hosts. Our service includes:

  • Automated guest communication via WhatsApp
  • AI-powered responses to common guest questions
  • Property knowledge base management
  • Escalation to property managers for complex issues
  • Conversation monitoring and analytics

3. Account Registration

To use our Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Subscription and Payment

4.1 Plans and Pricing

We offer monthly (€35/month) and annual (€378/year) subscription plans. Prices may change with 30 days notice.

4.2 Free Trial

New accounts receive a 7-day free trial. You will not be charged until the trial ends. You may cancel at any time during the trial.

4.3 Billing

Subscriptions are billed in advance. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.4 Cancellation

You may cancel your subscription at any time from your dashboard. Upon cancellation, you will retain access until the end of your current billing period. We do not provide refunds for partial months or unused time.

5. Acceptable Use

You agree NOT to use our Service to:

  • Violate any laws or regulations
  • Send spam or unsolicited messages
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Distribute malware or harmful code
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any illegal vacation rental activities
  • Mislead guests about property conditions or amenities
  • Collect personal data beyond what's necessary for hosting

6. WhatsApp Number Assignment

Each property is assigned a dedicated WhatsApp number. You understand that:

  • The number is provided for use with our Service only
  • You may not transfer, sell, or use the number outside our platform
  • Number availability depends on our inventory
  • If you cancel, the number will be released back to our pool

7. Content and Data

7.1 Your Content

You retain ownership of content you upload (property information, images, documents). You grant us a license to use this content to provide the Service.

7.2 AI Responses

Our AI generates responses based on the information you provide. You are responsible for ensuring the accuracy of your property information. We are not liable for incorrect AI responses caused by inaccurate input data.

7.3 Guest Data

You acknowledge that guest interactions through our Service are subject to our Privacy Policy. You are responsible for informing guests that they are communicating with an AI assistant.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will notify you of planned downtime when possible.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the past 12 months
  • We are not responsible for guest actions or property-related issues
  • We are not liable for losses caused by AI response errors

10. Indemnification

You agree to indemnify and hold harmless The Guest Helper from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Fail to pay subscription fees
  • Abuse the Service or other users

Upon termination, your right to use the Service ceases immediately. We may delete your data after 30 days.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Spain. If you are an EU consumer, you retain your rights under local consumer protection laws.
